1.                  I am desirous of getting registered and availing the benefits of being registered as an IT Professional/ Knowledge Professional(ITP/KP) with a verified background in the National Skills Registry (NSR) being developed and maintained by NSDL Database Management Limited (NDML), at the initiative of NASSCOM.

2.                  I have electronically submitted my application containing my personal particulars for inclusion in the NSR database as an IT Professional / Knowledge Professional. (ITP/KP).

3.                  Further, I agree to provide NDML authentication of my identity by way of my Aadhaar Paperless Offline e-KYC or Video KYC and upload documents evidencing my identity to facilitate my exclusive identification and to receive the Unique Identity Number [hereinafter referred to as IT Professional Identification Number (ITPIN)] to be used by me during the period of my association with NSR.

 4.                  I am aware of the following and voluntarily and irrevocably agree and consent to the following :--

a)          That NSR will record the information as provided by me and I shall endeavor to ensure to update my personal particulars previously provided by me so as to make available to the viewers authorised by me my current personal particulars (Profile as well as my updated Profile).  

b)           That my employer or any user authorised by me  may arrange to verify  my Profile either through a Background Checker Empanelled (EBC) by NDML or through its own source at its cost. If I request for verification of my Profile, an EBC randomly selected by NDML may verify my Profile for which I shall bear the costs. The EBC may record its findings whether positive or negative and upload the report against my profile. My employer company can update on NSR the details of the background check report whether positive or negative available with it against my details entered by me on NSR. If I have any query or grievance regarding the findings as recorded against my profile by the EBC or employer company, then I will inform the same to NDML within a one year of the posting of these findings on my NSR profile.

c)            That I can specify the users who may view my Profile on NSR. However, my current employer may access my profile whether verified or not from time to time, with the comments whether positive or negative and the report appended by the EBC, if any, at any time, during my employment.

d)           That any user, other than my current employer, authorised by me may view my profile whether verified or not along with the comments whether positive or negative and the report appended by the EBC, if any, during the period specified by me.

e)            That any user, other than my current employer, user authorised by me may view my unverified or verified profile along with the comments whether positive or negative and the report appended by the EBC, if any, for a period of sixty (60) calendar days from the date of authorisation in the event I do not specify the viewing period.

f)             That I have no objection whatsoever if any present or past employer company posts the relieving details including the details of termination of services in the NSR and any other Company can view the same.  

g)             That my employer company as recorded by me on NSR database, can verify the employment details as entered by me and can confirm the correctness of this information and record the same on NSR.   

h)             That I shall have the authority to access, enter, modify or update my profile on NSR.  

i)            That NDML and/or its officials shall not be responsible for usage of my personal particulars by my employer / users authorised by me. and I shall have no claim whatsoever against NDML or its officials.

j)            That I shall not question the source of any information relating to me or my employment received by NSR / NDML or displayed by them on the System for the information of any person/s, including any company, firm, proprietor or body of persons either incorporated or otherwise, as may be deemed fit by the NSR / NDML.

 5.                  I further agree as follows:- 

a)            To pay the one time registration fees of र 300 (plus applicable tax) or as per the schedule of charges specified by NDML from time to time either myself or through my present employer. I authorize the employer to deduct the aforesaid amount from the salary payable to me.

b)           To pay the Annual Maintenance Fee of र 100 [plus applicable tax] or as per the schedule of charges specified by NDML from time to time either myself or through my present employer. I authorise the employer to deduct the aforesaid amount from the salary payable to me.  The Annual Maintenance Fee will be payable for each financial year or any part thereof.

c)            To provide the necessary documents (originals and copies) to the EBC specified by NDML and extend necessary co-operation for successful completion of verification of the personal information provided by me.

d)           The failure to provide the details / documents / information or extend co-operation to the EBC to verify my personal information may lead the EBC to construe that information provided by me in the application is not verifiable.

e)            I agree to exercise  care to retain control of my password and user identity to gain access to NSR and shall take all steps to prevent its disclosure or compromise to a person not authorised by me.

6.                  I acknowledge that in the event of my failure to pay the annual fees, my right to access, enter, modify or update or request for verification or exhibit my profile to an authorised viewer / subscriber / user will be suspended.

7.                  I declare that I do not have any profile on NSR. I am aware that my subsequent profile (if any) may be marked as duplicate profile on the NSR and may be revoked. In such an event I shall not be entitled to any refund of fees paid.

8.                  I agree to save NDML harmless from and against any claim, loss, damage, proceedings including legal costs, arising out of or my registration with NSR and the usage of such NSR by subscribers to NSR, and acknowledge that the benefits accruing to me out of such participation is adequate consideration for the same.

9.                  I agree that I shall not hold NDML/NSR system responsible/liable, in any manner whatsoever, for any commission or omission by anybody arising out of any information displayed on the website of NDML/NSR system.

 10.                   I agree that during the creation or operation of my NSR profile I will not host, display, upload, modify, publish, transmit, update or share any information that -  

a)            belongs to another person and to which the I does not have any right to;

b)           is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;  

c)            harm minors in any way;

d)           infringes any patent, trademark, copyright or other proprietary rights;

e)            violates any law for the time being in force;

f)            deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

g)            impersonates another person;

h)            contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

i)            threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

11.                   I agree that in case of non - compliance with rules and regulations of applicable compliances, NSR Terms and Conditions or Privacy Policy, NDML / NSR has the right to immediately terminate my access or usage rights of NSR and remove the non-compliant information.

12.                   I declare that I have read and understood the Privacy Policy hosted on NSR website.

13.                   I declare that the personal particulars provided by me are correct, true and accurate and I shall be personally liable for all consequences of error(s), inaccuracy (ies) or misrepresentation(s) in the information provided by me.
